The Environmental Declaration

We, the undersigned, guided by the principles of international law, the Charter of the United Nations, the Universal Declaration of Human Rights, the Final Act of the Conference on Security and Cooperation in Europe, the obligations and principles of the OSCE, the Paris Charter for a new Europe, and as well as the goals and principles of international law, including international human rights law and international humanitarian law

Expressing our full support and unwavering commitment to the independence, sovereignty and territorial integrity of Ukraine within its internationally recognized borders, as well as solidarity with its government and people,

Recalling the obligations of all states under Article 2 of the Charter of the United Nations, including the obligation to refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state or by any other means, which is contrary to the purposes of the United Nations and to resolve its international disputes by peaceful means,

We strongly condemn the aggressive war of the Russian Federation against Ukraine and call/demand from the Russian Federation to immediately stop it, completely and unconditionally withdraw its troops from the sovereign territory of Ukraine within its internationally recognized borders of 1991, including territorial waters,

We recognize that the aggressive war of aggression of the Russian Federation against Ukraine causes significant damage to the environment of Ukraine, endangers the destruction of natural resources and elements of flora and fauna, and also significantly undermines global efforts to maintain the environment and reduce emissions of toxic substances,

Taking into account UN General Assembly Resolution A/RES/ES-11/5 “Provision of remedies and reparations in connection with aggression against Ukraine”, which expresses serious concern about, among other things, the destruction of natural resources, and which it is determined that the Russian Federation must bear the legal consequences of all its internationally illegal acts, including compensation for damage, including any damage caused by such acts, and the need to create, in cooperation with Ukraine, an international mechanism for compensation for damages, losses or damage is separately determined, which are the result of internationally illegal acts of the Russian Federation in Ukraine or against Ukraine,

Referring to the Resolution of the European Parliament of November 23, 2022 2022/2896(RSP) “On the recognition of the Russian Federation as a state sponsor of terrorism”, which calls on member states to work on the creation of a comprehensive International Compensation Mechanism, including an International Register of Damages, and actively cooperate with the Ukrainian authorities on this issue,

Taking into account the Resolution of the Parliamentary Assembly of the Council of Europe No. 2506 (2023) “Political consequences of the war of aggression of the Russian Federation against Ukraine”, in which the Parliamentary Assembly reiterates its strong condemnation of the war of aggression of the Russian Federation against Ukraine as a violation of international law and an act of unprecedented seriousness in itself, and because of its far-reaching, among other things, environmental consequences in Europe and beyond,

Taking into account the Resolution CM/ Res (2023)3 on the creation of the Expanded Partial Agreement on the Register of Damages Caused by the Aggression of the Russian Federation against Ukraine, which condemns all violations of international law, including attacks directed at the environment in Ukraine, and it is also determined that the Register of Damages, caused by the war of aggression of the Russian Federation against Ukraine will serve as a documentary form for submitting evidence and claim information about damage, losses or injuries,

Guided by the fact that the creation of an international platform for assessing environmental damage, will implement the Clause 8 of the “Peace Formula of the President of Ukraine Volodymyr Zelenskyy”, which also focuses on the large-scale environmental damage caused by the aggressive war of the Russian Federation against Ukraine, which poses a threat not only to Ukraine, but also to the whole world,

Once again, confirming our determination to continue to support Ukraine until the full restoration of its territorial integrity within the internationally recognized borders of 1991 and throughout the process of sustainable recovery and reconstruction of Ukraine, –

The signatories of the Declaration decided to:

  1. To emphasize that the ongoing aggressive war of the Russian Federation against Ukraine leads to severe and difficult to recover consequences for the environment of Ukraine, in addition, such damage may be irreparable and entail the irreversible destruction of elements of flora and fauna, which requires urgent measures to protect the environment, fixing and compensating for the damage caused to it, as well as restoring the environment as soon as possible.
  2. To emphasize that the damage to the environment from the ongoing aggressive war of the Russian Federation against Ukraine is cross-border and causes damage not only to the environment of Ukraine but also to the environment of the countries of the entire region due to the movement of environmental elements polluted as a result of military operations, such as water in the Black and Azov seas, water in rivers, groundwater, air, etc. to other countries, as well as the destruction of representatives of flora and fauna that migrate or live on the territory of different countries.
  3. Emphasize that the aggressive war of the Russian Federation against Ukraine and its destruction of the Kakhovskaya HPP, which is directly technologically connected with the largest nuclear power plant in Europe – the Zaporizhzhya NPP, puts the world at risk of a nuclear disaster, in connection with which the signatories of the declaration call for immediate demilitarization territory of the Zaporizhzhia NPP, withdraw all armed formations, all military equipment, all explosives from there, and transfer control over it to Ukraine.
  4. To create an international environmental platform for the assessment of environmental damage from the aggressive war of the Russian Federation against Ukraine, the purpose of which is to promote the protection, restoration and compensation of damage to the environment of Ukraine.
  5. Provide further multilateral cooperation within the framework of the International Environmental Platform for assessing environmental damage from aggressive war, as well as bilateral cooperation between partner countries and Ukraine, aimed at:
    1. Expert, technical, and financial support aimed at increasing quality capabilities for recording damage to Ukraine’s environment and the highest quality verification and assessment of such damage.
    1. Of the methods adopted in Ukraine for assessing the damage caused to the environment, in particular, involving the leading national and international institutions with the ultimate goal of providing the highest quality standard of verification and damage assessment that can be used both by Ukraine and by other countries whose environment suffers damage, as a result of the ongoing armed aggression of the Russian Federation.
    1. Collection and exchange of data on the damage caused to the environment as a result of the ongoing aggressive war of the Russian Federation against Ukraine, presentation and initiation of issues of prevention of negative consequences and prosecution of the guilty, including with the use of international legal mechanisms.
    1. Cooperation in the field of legal regulation for the purpose of fair recording of environmental damage, its assessment and recovery of environmental damage.
  6. To establish cooperation between the participants of the International Environmental Platform, Ukraine and the elements of the International Mechanism for compensation for damage caused to develop uniform quality standards for recording, verification and assessment of damage caused to the environment.
  7. Emphasize that the scale of damage caused to the environment as a result of the ongoing aggressive war of the Russian Federation against Ukraine indicates the need for appropriate criminal prosecution of crimes against the environment committed on the territory of Ukraine or against Ukraine in accordance with national legislation and international law.
  8. Contribute to the restoration of the natural environment of Ukraine, in particular measures for land reclamation and demining, revival of destroyed forests and nature reserves, creation of new national parks and nature conservation zones, cleaning of rivers, lakes and sea waters, etc.
  9. Other countries wishing to contribute to efforts to ensure the support, preservation and restoration of the environment of Ukraine and the world may join this Declaration at any time.

Summing up, the signatories of the Declaration agreed that:

  1. Together, they will face new challenges and threats to the environment caused by the ongoing armed invasion of the Russian Federation against Ukraine, and jointly make efforts to strengthen countermeasures against these threats, uncompromisingly asserting that environmental protection is an urgent task facing all members of the international community.
  2. The need for a coordinated global response to condemn and address the environmental damage caused by the ongoing aggressive war of the Russian Federation against Ukraine is undeniable.
  3. The environmental damage caused by the ongoing aggressive war of the Russian Federation against Ukraine has a systemic, cross-border and global scale. Its scale, duration and nature negatively affect the results of the global community’s long-term efforts to combat climate change and reduce emissions of any poisonous and polluting substances.
  4. The Russian Federation bears full responsibility for the illegal, unjustified and unprovoked war of armed invasion against Ukraine, which seriously undermined global environmental security and for which it must bear full responsibility.
  5. The Russian Federation must bear responsibility for all the damage caused by the aggressive war to the environment and compensate for it.
  6. The history of manifestations of aggressive wars proves that their result is always significant damage to the environment, and international efforts to protect the environment should become one of the leading deterrents not only to stop the ongoing aggressive war of the Russian Federation against Ukraine but also to deter manifestations of armed invasions in the future.

The implementation of the “Peace Formula of the President of Ukraine, Volodymyr Zelenskyy”, contributes to the effective consolidation of international efforts to counter environmental threats that arise as a result of the aggressive war of the Russian Federation and thus makes a significant contribution to ensuring global efforts to protect the environment and preserve our planet for future generations.

Ми, що підписалися нижче, керуючись принципами міжнародного права, Статутом Організації Об’єднаних Націй, Загальною декларацією прав людини, Заключним актом Наради з безпеки і співробітництва в Європі, зобов’язаннями та принципами ОБСЄ, Паризькою хартією для нової Європи, а також цілями і принципами міжнародного права, включаючи міжнародне право прав людини та міжнародне гуманітарне право

Висловлюємо нашу повну підтримку та непохитну відданість незалежності, суверенітету та територіальній цілісності України в межах її міжнародно визнаних кордонів, а також солідарність з її Урядом та народом,

Нагадуємо про зобов’язання всіх держав згідно зі статтею 2 Статуту Організації Об’єднаних Націй, включаючи зобов’язання утримуватись у своїх міжнародних відносинах від загрози силою або її застосування проти територіальної цілісності чи політичної незалежності будь-якої держави або будь-яким іншим способом, що суперечить цілям Організації Об’єднаних Націй і для вирішення своїх міжнародних спорів мирними засобами,

Рішуче засуджуємо агресивну війну Російської Федерації проти України та вимагаємо від Російської Федерації негайно її припинити, повністю та безумовно вивести свої війська з суверенної території України у її міжнародно визнаних кордонах 1991 року, включаючи територіальні води,

Визнаємо, що агресивна війна Російської Федерації проти України завдає суттєвої шкоди довкіллю України, ставить під загрозу знищення природних ресурсів та елементів флори і фауни, а також суттєво підриває загально-світові зусилля з підтримки довкілля та зменшення викидів забруднюючих речовин,

Беручи до уваги Резолюцію Генеральної Асамблеї ООН A/RES/ES-11/5 «Забезпечення засобів правового захисту та репарацій у зв’язку з агресією проти України», що висловлює серйозне занепокоєння щодо, зокрема, знищення природних ресурсів, та у якій визначено, що Російська Федерація повинна нести правові наслідки всіх своїх міжнародно-протиправних діянь, включаючи відшкодування шкоди, у тому числі будь-якої шкоди, заподіяної такими діяннями, та окремо визначає необхідність створення у співпраці з Україною міжнародного механізму для відшкодування збитків, втрат чи шкоди, які є наслідком міжнародно-протиправних діянь Російської Федерації в Україні чи проти України,

Посилаючись на Резолюцію Європейського парламенту від 23 листопада 2022 року 2022/2896(RSP) «Про визнання Російської Федерації державою-спонсором тероризму», в якій закликано держави-члени працювати над створенням комплексного міжнародного механізму компенсації, включаючи міжнародний реєстр збитків, і активно співпрацювати з українською владою з цього питання,

Беручи до уваги Резолюцію Парламентської асамблеї Ради Європи № 2506 (2023) «Політичні наслідки загарбницької війни Російської Федерації проти України», у якій Парламентська асамблея повторює своє рішуче засудження агресії  Російської Федерації в Україну як порушення міжнародного права та акту безпрецедентної серйозності як самого по собі, так і через його далекосяжні, зокрема, екологічні наслідки в Європі та за її межами,

Враховуючи Постанову CM/ Res( 2023)3 про створення Розширеної часткової угоди про реєстр збитків, заподіяних агресією Російської Федерації проти України, якою засуджено всі порушення міжнародного права, зокрема, атаки направлені на довкілля в Україні, а також визначено, що реєстр збитків, заподіяних агресивною війною Російської Федерації проти України слугуватиме документальною формою внесення доказів та претензійної інформації про шкоду, збитки чи ушкодження,

Керуючись тим, що створення міжнародної платформи для оцінки збитків довкіллю, спрятиме реалізації пункту 8 Формули миру Президента України Володимира Зеленського, яким також акцентовано увагу на масштабній екологічній шкоді, заподіяній агресивною війною Російської Федерації проти України, та визначено, що вона становить загрозу не лише для України, але й для всього світу,

Вкотре, підтверджуючи нашу рішучість, продовжувати підтримувати Україну до повного відновлення її територіальної цілісності у міжнародно визнаних кордонах 1991 року і протягом усього процесу сталого відновлення та реконструкції України, –  

Підписанти Декларації вирішили:

  1. Наголосити на тому, що агресивна війна Російської Федерації проти України, що триває, призводить до тяжких та важко відновлювальних наслідків для довкілля України, окрім того, така шкода може бути непоправною і спричинятиме безповоротне знищення елементів флори і фауни, що потребує нагальних заходів задля захисту довкілля, фіксації та відшкодування завданої йому шкоди, а також якнайшвидшого відновлення довкілля.
  2. Підкреслити, що шкода довкіллю від агресивної війни Російської Федерації проти України, що триває, є транскордонною і завдає шкоди не тільки довкіллю України, а також довкіллю країн всього регіону за рахунок переміщення, засмічених внаслідок військових дій елементів довкілля, таких як вода у Чорному та Азовському морях,  вода у річках, ґрунтові води, повітря, тощо до інших країн, а також знищення представників флори та фауни, що мігрують або живуть на території різних країн.
  3. Акцентувати увагу на тому, що агресивна війна Російської Федерації проти України та спричинене нею знищення Каховської ГЕС, яка безпосередньо технологічно пов’язана з найбільшою в Європі атомною електростанцією – Запорізькою АЕС, ставить світ перед загрозою ядерної катастрофи, у зв’язку із чим підписанти декларації закликають негайно демілітаризувати територію Запорізької АЕС, вивести звідти всі збройні формування, військову техніку, вибухові речовини та передати контроль над нею Україні.
  4. Створити Міжнародну екологічну платформу для оцінки збитків довкіллю від агресивної війни Російської Федерації проти України, метою якої є сприяння захисту, відновленню та відшкодуванню шкоди довкіллю України.
  5. Передбачити подальшу багатосторонню співпрацю в рамках Міжнародної екологічної платформи для оцінки збитків довкіллю від агресивної війни Російської Федерації проти України, а також двосторонню співпрацю між країнами-партнерами та Україною, направлену на:
    1. Експертну, технічну та фінансову підтримку, направлену на збільшення якісних спроможностей по фіксації шкоди довкіллю України та найбільш якісної верифікації та оцінки такої шкоди.
    1. Проведення незалежного експертного аналізу прийнятих в Україні методик оцінки шкоди, завданої довкіллю шляхом, зокрема, залучення провідних національних та міжнародних інституцій з кінцевою метою забезпечити найбільш якісний стандарт верифікації та оцінки збитків, що може бути використаний як Україною так і іншими країнами, довкілля яких зазнає збитків, унаслідок збройного вторгнення Російської Федерації в Україну, що триває.
    1. Збір та обмін даними щодо шкоди завданої довкіллю, внаслідок агресивної війни Російської Федерації проти України, що триває, представлення та ініціювання питань попередження негативних наслідків і притягнення винних до відповідальності, у тому числі із застосуванням міжнародно-правових механізмів.
    1. Співпрацю у сфері правового регулювання з метою справедливої фіксації завданої довкіллю шкоди, її оцінки та стягнення завданих довкіллю збитків.
  6. Налагодити співпрацю між учасниками Міжнародної екологічної платформи, Україною та елементами Міжнародного механізму відшкодування завданої шкоди для вироблення єдиних стандартів якості фіксації, верифікації та оцінки завданої довкіллю шкоди.
  7. Наголосити, що масштаби шкоди, завданої довкіллю внаслідок агресивної війни Російської Федерації проти України, що триває, свідчать про необхідність відповідного кримінального переслідування злочинів проти довкілля, вчинених на території України чи проти України відповідно до національного законодавства та міжнародного права.
  8. Сприяти відновленню навколишнього природного середовища України, зокрема заходам з рекультивації та розмінування земель, відродження знищених лісів і заповідників, створення нових національних парків і природоохоронних зон, очищення річок, озер і морських вод тощо.
  9. Інші країни, які бажають зробити свій внесок у зусилля, спрямовані на забезпечення підтримки, збереження та відновлення довкілля України та світу, можуть приєднатися до цієї Декларації в будь-який час.

Підсумовуючи, підписанти Декларації погодилися, що:

  1. Разом будуть протистояти новим викликам і загрозам довкіллю, викликаним збройним вторгненням Російської Федерації в Україну, що триває, та спільно докладати зусилля для посилення протидії цим загрозам, безкомпромісно стверджуючи, що охорона довкілля є актуальним завданням, яке стоїть перед усіма членами міжнародного співтовариства.
  2. Необхідність скоординованої глобальної відповіді для засудження та подолання екологічної шкоди, спричиненої агресивною війною Російської Федерації проти України, що триває, – є беззаперечною.
  3. Шкода довкіллю, що завдається агресивною війною Російської Федерації проти України, що триває, має системний, транскордонний та глобальний масштаби. ЇЇ масштаби, тривалість і характер негативно позначаються на результатах багаторічних зусиль світової спільноти щодо боротьби зі зміною клімату, скорочення викидів будь-яких отруйних і забруднюючих речовин.
  4. Російська Федерація несе повну відповідальність за незаконне, невиправдане та неспровоковане збройне вторгнення в Україну, яке серйозно підірвало глобальну екологічну безпеку, і за яке вона повинна нести повну відповідальність.
  5. Російська Федерація повинна нести відповідальність за всю шкоду, завдану агресивною війною довкіллю, і компенсувати її.
  6. Історія проявів агресивної війни доводить, що їх результатом завжди є значна шкода довкіллю, а міжнародні зусилля щодо захисту довкілля мають стати одним із провідних стримувальних факторів не лише для припинення агресивної війни Російської Федерації проти України, що триває, а й для стримування проявів збройного вторгнення в майбутньому.

Імплементація Формули миру Президента України Володимира Зеленського сприяє ефективній консолідації міжнародних зусиль щодо протидії екологічним загрозам, які виникають внаслідок агресивної війни Російської Федерації, і таким чином робить вагомий внесок в забезпечення глобальних зусиль із захисту довкілля та збереження нашої планети для майбутніх поколінь.
